House Bill 310 – Background Checks, Sources 

On January 13th, 2020, House Bill 310 (H0310) was introduced at the request of the Idaho Department of Health and Welfare.

This legislation seeks to amend section 4(c) of Idaho Code 56-1004A. The code references the resources which the Department of Health and Welfare utilizes to conduct background checks on individuals working with vulnerable adults or children. The current code references the FBI’s National Crime Information Center (NCIC) as a possible source by which the background check is run. Due to federal law, the Dept. of Health and Welfare does not have access to the NCIC and as such the amendment strikes the NCIC as a source of reference in the Idaho code. 

According to the legislation’s fiscal note, this amendment has no fiscal impact and background checks performed will continue as previously conducted by the Department of Health and Welfare.

H0310 was reported out of the House Health and Welfare Committee on January 22, 2020, with a “Do Pass” recommendation.
