House Bill 175: Administrative Procedure Act

On February 21, 2019, State Representative Greg Chaney (R-Caldwell) introduced House Bill 175 (H0175). This legislation seeks to establish an office of Administrative Hearings to handle contested case proceedings. The proposed office would be housed in the Department of Self Governing Agencies. It would have the authority to hear all contested case proceedings except for those involving the Public Utilities Commission, the Industrial Commission and the Department of Water Resources and any other commission specifically exempted by law.

House Bill 175’s fiscal note projects a startup cost of $1.5 million with ongoing costs billed to the various state agencies. Proponents for the legislation expect the new office to be self-sustaining and save money by having a dedicated entity to address contested cases instead of hiring contract hearing officers.
